If you have been fined you can appeal, avoiding to waste time and money, and chose the right proceedings in order to win your appeal. Here you can find information about payment, how and where you should turn to a prefect or to the Justice of the Peace.
Fine appeal: when
Have you been fined ? Before appealing you should be sure that the fine is irregular.
Frequent cases of appeal are:
- wrong vehicle identification;
- wrong numberplate;
- there is no reference to appeal presentation;
- particulars of lawbreakers and vehicle owner (jointly and severally liable) are not correct;
- the appeal refers to a vehicle sold before the date of the offence.
Moreover you can appeal when the offence is not an administrative one.
If you appeal to a prefect you should not pay the deposit that once was superior to the fine.
If you have renounced to appeal you can pay :
- at Appeal Boards;
- at post offices through a current account attached to the violation notice;
- at the banks of the Roman town hall (Banca di Roma, B.N.L., Monte dei Paschi di Siena);
- tobacconist’s shops having a special agreement with L.I.S. – Lottomatica Italia Servizi.
Fine appeal: where
A fine appeal can be submitted to a prefect by the Municipal Police before 60 days from the notice. In Rome there are territorial commands or the Appeals Board in via Ostiense. Otherwise you can turn to a Justice of the Peace.
These two proceedings have some differences:
- the prefect listens the person concerned only by request while the Justice of the Peace will set a hearing;
- the prefect has to rule on the appeal in a short period otherwise tacit consent applies, while proceedings managed by the Justice of the Peace have no time limits.
Appeals to the Justice of the Peace regard only violation notices of the highway code.
